Terms of purchase

The parties

The seller is Nordic Noir Group AS, (NRG) Org no. 923 436 162 , company address: Kongensgate 24, 0153 OSLO, hereinafter referred to as the seller.

Buyer is the consumer who places the order, and is hereinafter referred to as the buyer/purchaser.

CONDUCT OF TRADE

Shopping here at Clermonte.no is very easy. You click "add to cart" on the product you want to buy. The item will then be saved in your shopping cart, so you can easily continue shopping or go directly to checkout for payment. There you simply choose shipping and payment method and then enter your contact and delivery address.

When you have completed a transaction with us, you accept and agree to our terms and conditions. When trading an item, you accept and agree to the product information and notices.

PRIVACY, SECURITY AND PERSONAL INFORMATION

In connection with the order, you agree that NRG stores and uses your information. We do this to fulfill our obligations to you. We also document all communications we have with you via email, in order to be able to provide the service that you expect from us. NRG will not disclose your personal information to third parties. Under the Privacy Act, you have the right, once a year, to be part of the information we have stored about you. We reserve the right to use email to send marketing and newsletters if you have given consent for this.

PRICES

All our prices are incl. VAT and excl. shipping. Our prices may vary and are therefore subject to price changes in relation to the market and other factors. We also reserve the right to make typographical/printing errors on our website.

CANCELLATION

When canceling an order item, a 10% transaction fee will be charged. When canceling an item that is in stock, there will be no fee.

PAYMENT

The payment methods we have are: VISA, MasterCard, Vipps and Klarna. If you as a customer pay by card, the purchase price will be charged the same day. When paying via Vipps, the amount will only be reserved until the order has been processed and shipped from our warehouse. When paying via Klarna, you have 14 days to pay the invoice from the date we process your order (not from the date you place the order on kouture.no).

DELIVERY AND PICKUP

The customer chooses the delivery method of the product at checkout. The delivery time for items that are in the main warehouse is normally 1-3 days (depending on where in the country the product is to be shipped). In the event that products are in high demand, longer delivery times may occur. If we are out of stock of the item in the main warehouse, the delivery time may be up to 2 months (in which case we will provide information about this in the individual article to which this applies). When pre-ordering, we will provide the earliest and latest delivery date for the individual item. If something else applies, we will write this in the individual article to which this applies.

NRG is responsible for the goods until they are delivered to the customer.

If the buyer does not pay or fulfill the other obligations under the agreement or the law, and this is not due to the seller or circumstances on the seller's part, the seller may, in accordance with the rules in the Consumer Purchase Act, Chapter 9, depending on the circumstances, hold return the item , demand fulfillment of the agreement, demand the agreement be terminated and claim compensation from the buyer. The seller may also, depending on the circumstances, charge interest for late payment, collection fees and a reasonable fee for uncollected goods .

The customer is responsible for collecting the item and if the item is not collected within 14 days, a shipping + return fee of 99,- per way + a fee of NOK 100,- will be incurred.

It is also the customer's responsibility to request the item if it has not been received within the expected delivery time. The customer is responsible for providing the correct delivery address - and is responsible for paying shipping (both ways) if the item is returned to us due to an incorrect or incomplete address.

If the customer does not maintain the 14-day return deadline, and still returns goods beyond this, they will be responsible for full return shipping with tracking back from the store to the customer. We do not process returns that are beyond the return deadline.

RIGHT OF CANCELLATION

The right of withdrawal applies to the online store Clermonte.no. According to Norwegian law (the Withdrawal Act), customers have the right to withdraw from a purchase. If you as a customer regret your purchase from us, you must notify us within 14 days of receiving the goods.

In order for the right of withdrawal to be valid, the product must be returned in the condition in which the customer received it and within a reasonable time. The customer is responsible for the risk of return transport and must cover any costs associated with return shipping. We recommend that all our customers send with tracking.

DAMAGED GOODS AND RIGHT OF COMPLAINT

As you receive your order, it is important to check the items for damage or defects. Should the item be damaged or broken, you can contact us at tor@kaarelund.no for further instructions.

If there is a defect in the goods, the buyer must, within a reasonable time after it was discovered or should have been discovered, notify the seller that he or she will claim the defect. The buyer has always made a complaint in time if this occurs within 2 months of the defect being discovered or should have been discovered. Complaints may be made no later than two years after the buyer took over the goods.

If the goods or parts of them are intended to last significantly longer than two years, the period for complaints is five years. If the goods have a defect and this is not due to the buyer or circumstances on the buyer's side, the buyer may, in accordance with the rules of the Consumer Purchase Act, Chapter 6, depending on the circumstances to keep the purchase price back , to choose between correction and redelivery , demand price reduction , demand the agreement be terminated and/or demand replacement from the seller.

Complaints to the seller should be made in writing.

Correction or resubmission

The buyer can choose between demanding the defect be rectified or delivery of equivalent goods. The seller may, however, oppose the buyer's claim if the implementation of the claim is impossible or causes the seller unreasonable costs. Rectification or replacement shall be carried out within a reasonable time. The seller is not entitled to make more than two attempts to remedy the same defect.

Price reduction

The buyer may demand an appropriate price reduction if the goods are not repaired or replaced. This means that the ratio between the reduced and the agreed price corresponds to the ratio between the value of the goods in their defective and contractual condition. If special reasons justify it, the price reduction may instead be set equal to the significance of the defect for the buyer.

Raising

If the goods are not corrected or replaced, the buyer may also cancel the purchase when the defect is not insignificant.

RETURN/EXCHANGE OF GOODS

When returning an item, the customer is responsible for the risk of return transport and must cover any costs associated with return shipping. When exchanging an item, the customer is responsible for any costs associated with return shipping.

 

REFUND

When refunding amounts after canceling an order or by exercising the right of withdrawal, the refund will only be made when:

  • the amount is registered in our account or
  • The product has been received in return and in the condition we sent it.

Conflict resolution

Complaints must be addressed to the seller within a reasonable time, cf. points 9 and 10. The parties shall attempt to resolve any disputes amicably. If this is unsuccessful, the buyer may contact the Norwegian Consumer Authority for mediation. The Norwegian Consumer Authority is available by telephone at +47 23400600.

The European Commission's complaint portal can also be used if you wish to file a complaint. This is particularly relevant if you are a consumer residing in another EU country. The complaint is filed here: http://ec.europa.eu/odr .
